Terms of Service

These terms govern your use of the Nayvadius family of websites and products. By using any product, you agree to these terms. The legal operator is D3SMC LLC, a Texas limited liability company. Throughout these terms, "we," "us," and "Nayvadius" refer to D3SMC LLC.

Scope

These terms apply to the apex site (nayvadius.ai) and, by default, to each product subdomain. Individual products may publish more specific terms at /terms; where they conflict with this document, the product-specific terms govern for that product.

Accounts

Some Nayvadius products require an account. You are responsible for keeping your credentials secure and for activity under your account. Notify us at support@nayvadius.ai promptly if you suspect unauthorized access.

Payments and refunds

• Payments are processed by Stripe. We do not store your full payment card details.
• Prices are in USD unless otherwise stated. Sales tax / VAT is added at checkout where applicable.
• Refund policy: one-time purchases are refundable within 30 days of purchase, no questions asked. Subscription products (where available) can be cancelled at any time; the cancellation takes effect at the end of the current billing period.
• Chargebacks initiated without first contacting us for a refund may result in account suspension.

Acceptable use

You may not use Nayvadius products to:

• Violate any law or third-party right.
• Send spam or unsolicited bulk communications.
• Generate content that is illegal, defamatory, or designed to deceive or harm.
• Reverse-engineer, scrape, or otherwise abuse the service in ways that degrade it for others.
• Resell or sublicense access to the service except as expressly permitted (e.g. Mozart Marketplace creator-published templates).

Intellectual property

We retain all rights in the Nayvadius brand, website content, and product source code (except where the source is open-source-licensed separately). Templates, graphs, and other artifacts you create or publish on a Nayvadius product remain yours; you grant us a non-exclusive license to host and display them as needed to operate the product.

Warranty disclaimer

Nayvadius products are provided as-is, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs may be inaccurate or unsuitable for your purpose; you are responsible for reviewing them before reliance.

Limitation of liability

To the maximum extent permitted by law, D3SMC LLC's total liability to you for any claim arising out of these terms or your use of Nayvadius products is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Termination

You can stop using the products at any time. We can suspend or terminate accounts that breach these terms, with notice except where immediate action is needed to protect users or the service. Provisions that by nature survive termination (payment obligations, IP, warranty disclaimer, limitation of liability, governing law) continue to apply.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of state and federal courts located in Travis County, Texas.

Changes

We may update these terms. Material changes will be announced on this page and reflected in the "Last updated" date at the top. Continued use after a change constitutes acceptance.
